The ServerBold.com reserves right to cancel, deny, suspend, terminate, modify or lock access to (control of) account and any Services (which includes right to cancel and transfer any kind of domain name registration) on any reason (determined by the ServerBold.com in sole & absolute discretion), which includes but not at all limited to following: (i) correct the mistakes made by the ServerBold.com in giving and delivering Services (which includes domain name registration); to protect integrity & stability of, or correct mistakes that are made by, domain name registry; to help with fraud & abuse detection or prevention efforts; to comply with the applicable state, local, national & international laws, rules or regulations; to comply with the requests of the law enforcement, which includes the subpoena requests; and to comply with dispute resolution procedure; to defend legal action and threatened legal action with no consideration for if legal action and threatened legal action get eventually determined with and without merit, and to avoid civil and criminal liability on part of the ServerBold.com, officers, directors, agents and employees, and ServerBold.com’s affiliates. In an event that the ServerBold.com need any exercise of the rights expressed to investigate potential breach and violation of terms or conditions of the Agreement, the service fees might continue to accrue in your accounts, or you may continue to stay responsible for payment of service fees, which accrue during relevant time.
Governing Law & Jurisdiction for the Disputes
Except otherwise set ahead in UDRP and similar policy with any dispute about Services given under the Agreement, Your rights & obligations or all actions being contemplated by the Agreement will get governed by laws of United Kingdom & Companies House, like Agreement was contract completely entered in and performed within Companies House UK . Also, you agree any action of enforcing the agreement or relating to use of Services should be brought in Companies House UK Court for Central District London, or suppose there’s not any jurisdiction in court, then in state court of United Kingdom, London
Notices
You also agree any notices needed to be given in Agreement by Us and You are deemed to be given in case delivered with account or domain name and WHOIS information You’ve provided. You acknowledge it is Your liability to maintain the contact information in account or domain name information You’ve provided.
Legal Age
You can attest You’re of the legal age for entering in the Agreement, with accordance to laws of jurisdiction.
Final Agreement
The Agreement, together with modifications, and constitute complete & exclusive agreement between Us and You, and supersede or govern all agreements, proposals, and other communications. The Agreement might not get amended and modified by You by means of written document that is signed by both You & authorized representative by Us. Applying for the ServerBold.com’s services by online application procedure or otherwise, using Services under the Agreement, you will acknowledge that you’ve read or agree to get bound by all the terms or conditions of the Agreement or documents incorporated by the reference.
No Agency Relation
Nothing contained at this Agreement will get construed as making any partnership, agency, and other type of the joint enterprise between parties hereto. Every party will make sure that foregoing persons will not at all represent to contrary, expressly, implicitly and by appearance.
Enforceability
In an event that provision of the Agreement will be unenforceable and invalid under applicable law and so held by the applicable court decision, this unenforceability and invalidity will not render the Agreement unenforceable and invalid as whole. We can amend and replace provision on one, which is valid or enforceable and that achieves, to extent possible, original objectives or intent reflected in an original provision.
Resale & Assignment
Except otherwise set herein, the rights under Agreement aren’t assignable and transferable. So, any attempt by creditors to get the interest of Your rights under Agreement, no matter whether by the attachment, garnishment, levy, or otherwise, renders the Agreement voidable at option. You also agree not to duplicate, reproduce, sell, copy, resell and exploit any of the commercial purposes of the Services (portion thereof) without the ServerBold.com’s express consent.
Force Majeure
Any party will not get deemed in the default hereunder, and nor it will hold other party liable for, or any cessation, delay or interruption in performance of the obligations hereunder because of causes beyond control including, however not at all limited to: flood; earthquake; storm; fire; act of God; natural disaster; terrorism; war; labor strike; armed conflict; boycott; lockout; shortages, supplier failures, delays or breaches; and any law, direction, order regulation, request and action of government, which includes federal, local and state governments having and claiming the jurisdiction over the ServerBold.com, and about any department, commission, agency, corporation, bureau, and other instrumentality of federal, state and local government, and of any civil and military authority; and any cause and circumstance, if of similar and dissimilar nature to foregoing, beyond reasonable control of affected party, given that party relying on the section will have given other party the written notice promptly and, at any event, in 5 days of the discovery thereof or (ii) will take all the steps necessary under circumstances to mitigate effects of force majeure on that such notice is totally based; given further, this in an event force majeure event that is described in Section extends for period in an excess of 30 days in aggregate, ServerBold.com might immediately terminate the Agreement.
